General Terms and Conditions
Article 1 – DEFINITIONS
In these terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer can make use of their right of withdrawal;
Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;
Day: calendar day;
Duration transaction: a distance contract relating to a series of products and/or services, where the obligation to deliver and/or purchase is spread over time;
Durable medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unaltered reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period;
Model form: the model withdrawal form provided by the entrepreneur that a consumer can fill in if they wish to exercise their right of withdrawal;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: an agreement whereby, within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the contract;
Technique for distance communication: a means that can be used to conclude a contract without the consumer and entrepreneur having met simultaneously in the same room;
General Terms and Conditions: these present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded and orders placed between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at the entrepreneur's premises and that they will be sent free of charge as soon as possible at the consumer's request.

If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions may be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable medium.

In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs shall apply accordingly, and in the event of conflicting terms, the consumer may always rely on the applicable provision that is most favorable to them.

If one or more provisions in these general terms and conditions are at any time wholly or partially void or annulled, the remainder of the agreement and these terms and conditions shall remain in effect, and the provision in question shall be replaced immediately by mutual agreement with a provision that approaches the scope of the original as closely as possible.

Situations not regulated in these general terms and conditions must be assessed "in the spirit" of these general terms and conditions.
Article 4 – The Offer

If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

The offer is non-binding. The entrepreneur is entitled to change and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. Obvious mistakes or errors in the offer do not bind the entrepreneur.

All images and specifications in the offer are indicative and cannot be grounds for compensation or dissolution of the contract. Images of products are a true representation, but the entrepreneur cannot guarantee that the displayed colors exactly match the real colors.

Each offer contains information that makes it clear to the consumer what rights and obligations are attached to accepting the offer, including: price (including taxes), shipping costs, method of payment, and the right of withdrawal.
Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the specified conditions.

If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance electronically. Until this receipt is confirmed, the consumer may dissolve the agreement.

The entrepreneur shall take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment.
Article 6 – Right of Withdrawal
For products:

When purchasing products, the consumer has the option to dissolve the contract without giving reasons for 14 days. This period starts on the day after receipt of the product by the consumer.

During the cooling-off period, the consumer shall handle the product and packaging with care. If they exercise their right of withdrawal, they shall return the product with all supplied accessories and—if reasonably possible—in its original condition and packaging.

To use the right of withdrawal, the consumer must notify the entrepreneur within 14 days of receipt using the model form and return the product within 14 days thereafter.
For services: 4. For services, the consumer has at least 14 days to dissolve the contract without giving reasons, starting from the day the contract is entered into.
Article 7 – Costs in Case of Withdrawal

If the consumer exercises their right of withdrawal, they shall bear at most the costs of returning the goods.

The entrepreneur will refund the amount as soon as possible, but no later than 14 days after withdrawal, provided the product has been received back or proof of return is provided.

The consumer is liable for any reduction in the value of the product caused by handling that goes beyond what is necessary to establish the nature and characteristics of the goods.
Article 8 – Exclusion of the Right of Withdrawal
The entrepreneur can exclude the right of withdrawal for certain products (e.g., custom-made items, perishable goods, sealed audio/video/software or hygienic products where the seal has been broken), provided this is clearly stated in the offer.
Article 9 – The Price

Prices will not be increased during the validity period stated in the offer, except for price changes resulting from changes in VAT rates.

All prices are inclusive of VAT.

Prices are subject to printing and typographical errors. The entrepreneur is not obliged to deliver the product at an incorrect price resulting from such errors.
Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products and/or services comply with the agreement and the specifications stated in the offer.

Any defects or incorrectly delivered products must be reported to the entrepreneur in writing within 2 months of delivery.

The warranty does not apply if the consumer has repaired/processed the products themselves or if the products have been exposed to abnormal conditions.
Article 11 – Delivery and Execution

The place of delivery is the address provided by the consumer.

The entrepreneur will execute accepted orders within 30 days unless a longer delivery period has been agreed. If delivery is delayed, the consumer has the right to dissolve the agreement free of charge but is not entitled to compensation.
Article 12 – Duration Transactions
Consumers can terminate open-ended or fixed-term contracts for the regular delivery of products or services at any time with a notice period of at most one month. Fixed-term contracts for products/services cannot be tacitly renewed for a fixed period.
Article 13 – Payment
Unless otherwise agreed, amounts owed by the consumer must be paid within 7 working days after the start of the cooling-off period.
Article 14 – Complaints Procedure

Complaints must be submitted fully and clearly described to the entrepreneur within 2 months after the consumer has discovered the defects.

Complaints will be answered within 14 days.

If a complaint cannot be resolved, a dispute arises. Consumers can contact the European ODR platform (http://ec.europa.eu/odr).
Article 15 – Disputes
Contracts between the entrepreneur and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad. The Vienna Sales Convention (CISG) does not apply.
Article 16 – Additional or Deviating Provisions
Additional or deviating provisions may not be to the detriment of the consumer and must be recorded in writing or in a way that the consumer can store them on a durable medium.
By signing up and paying you agree to the terms and conditions of Hagazussa-Art.
Booking and payment conditions
By booking and paying for an appointment with Hagazussa-Art the reservation for you is final.
You will receive a confirmation e-mail about your appointment.
The registration is only valid by full payment, which should be arranged latest 3 days before the event or coaching.

Cancellation
The customer can cancel out of serious reasons free of charge up to 2 working days before the appointment. The customer is obliged to send the cancellation via e-mail to petra.kuhlen@gmx.net. and we refund in this case.
If the cancellation is communicated less than 2 working days in advance, the costs for the session will be charged.
Booking
You can book your appointment over the form, per e-mail or telephone.
Confidentiality Obligation
Hagazussa -Art treats all information provided by participants in the coaching sessions and other particular events with the utmost confidentiality. Please notice that you as a participant is also expected to treat the information of other participants confidentially.
